Course objectives

The course aims at providing the basic knowledge of legal aspects associated with the production, elaboration and use of biomedical data in the wider context of EU law for the protection of fundamental rights, namely right to health and data protection

Results of learning outcomes

The completion of the course shall entail the knowledge of the right to health and data protection in the EU legal framework for the protection of fundamental rights. A specific competence will be developed with reference to legal aspects of use of biomedical data for research and therapy purposes.

Program

  1. Introduction: legal implications of the use of AI in biomedicine and healthcare in the context of international and EU protection of human rights.
  2. AI, healthcare and the right to the enjoyment of the highest attainable standard of physical and mental health in international and EU law.
  3. AI, biomedicine and the right to science: the right to participate and enjoy the benefits of scientific progress and its applications; implications on intellectual property rights.
  4. Introduction to EU actions in health and data protection: attribution and division of competences, different instruments of EU law, fundamental rights framework.
  5. Health protection and data governance in EU law and overview of the most relevant legal instruments.
  6. The General Data Protection Regulation (GDPR): definitions, scope of application, principles, data subjects’ rights, GDPR and AI.
  7. Health data in the GDPR: health data as sensitive data, data subjects’ rights, specific provisions regulating the processing of health data.
  8. The EU AI Act and its possible impact on healthcare.
  9. The proposal for a European Health Data Space (EHDS).
  10. Dealing with health data in AI in practice: case-studies.

Course delivery

The course is composed by frontal lessons (40 hours).

The final part of the course also envisages practical activity on case-studies.

Learning assessment methods

The assessment of learning will take place by means of an oral examination. The oral examination will count for the entire assessment, i.e. 30/30.
